In the terms below, “Refresh” means the Refresh website and its operators.
Registration
Registration is not required to view the Site, but may be required to participate in certain services or features including, but not limited to, Refresh Message Boards and competitions.
Information Provided By Site Visitors
Users of Refresh (hereinafter "visitors") are responsible for providing accurate information when required for registration or other function. Refresh will not be responsible for any claim however caused due to inaccurate user-supplied data.
Visitors hereby grant Refresh an irrevocable, royalty-free license to use information posted on Refresh. Refresh may copy, edit, distribute or create derivative works from such data.
Access to the Site
Refresh grants access to the Refresh website to all visitors, registered and unregistered. This access may be revoked at any time without notice.
Prohibited Activities
Certain activities are prohibited at Refresh including, but not limited to:
-- soliciting passwords, email addresses, telephone numbers or any other personal information via public or private methods;
-- uploading, posting, transmitting or linking to any illegal content;
-- threatening or insulting other Refresh visitors on the basis of sex, sexual preference or religion;

-- referencing, or posting links to, external websites, unless by prior approval from Refresh;
-- failing to obey instructions and/or notices as given by Refresh to any or all visitors.
Refresh visitors engaging in prohibited activities may have their account terminated and/or access blocked.
Commercial Activity
No part of the Site (including, but not limited to, the Message Boards and interactive features) may be used for any unapproved visitor or member-submitted commercial activity (including, but not limited to, website, music, film, videogame, brand and product promotion). Message Boards
Refresh members are responsible for posts made on the Refresh Message Boards using their registered account. The content of member-submitted Message Board posts is the opinion of the member only, not of Refresh and/or any affiliated party. Refresh accepts no liability for posts made on the Refresh Message Boards.
Password Security
Passwords chosen upon registration must be kept private. No responsibility will be taken for loss or damage caused by the divulging of a password by a visitor or member.
Permitted Use
Refresh grants visitors a revocable license to make copies of Refresh pages for their own personal, non-commercial use. This is on the express understanding that pages are to remain unchanged. No other use is permitted.
Personal Privacy
Refresh staff monitor the website on a continual basis, but it is impossible to review every visitor submission. Many parts of Refresh allow public posting or communication and it is visitors' responsibility to ensure they protect their privacy in these areas. Refresh is not responsible for actions arising out of information disclosed in any area of the Site. You are reminded not to disclose personal information in ANY area of Refresh. Any and all communication utilising the Refresh technology platform may be subject to monitoring and moderation.
Account Termination
Refresh may, at any time, suspend and/or remove registered members’ accounts if it is felt at the sole discretion of any Refresh staff member that any of the Terms Of Service, Member Agreements or Privacy Policy have been violated by that visitor. Refresh may also terminate accounts:
-- when required to do so by law;
-- to protect the rights, privacy or safety of Refresh staff members or other Refresh visitors;
-- in response to claims of intellectual property rights or copyright infringement by a third party or Refresh staff member;
-- in response to, at a Refresh staff member's sole discretion, inappropriate conduct by that registered Visitor.
External Links
Refresh may from time to time link to external websites. These websites are beyond the control of Refresh and therefore Refresh cannot be responsible for their content. Such websites are not necessarily endorsed by Refresh and Refresh provides no guarantees of any kind in relation to external websites.
Liability
Refresh accepts no liability whatsoever for any damage to users of the service, third parties or their property. Any claims brought against Refresh in connection with this website must be filed within one year of the event which it is alleged causes the liability.
Notice and Variation
Refresh reserve the right to amend this contract at any time including when required to do so by law. Amendments to this contract will be brought to the attention of all Refresh visitors in the manner detailed below. Continued use of this website after the requisite notice period will be taken to be acceptance of the variations made.
All notices to general users of the site, including notification of variations to this contract and alterations to the service provided, will be deemed to have been served if they are posted on the Refresh homepage for no less than 5 working days based on GMT hours. Any member-specific notices will served by an email to the member’s registered email address. Any notices that members and/or the public wish to serve on Refresh or other necessary communication should be emailed here.
Governing Law
This contract in its entirety is governed by the laws of England and Wales. Should any term of this agreement be found to not be fully enforceable, it shall remain in force to the full extent permissible under the law of England and Wales.
